הממשלה הודיעה שיהודה אליהו ימונה למנהל רשות מקרקעי ישראל – למרות התנגדות הייעוץ המשפטי – כשהיא מנופפת במכתבי תמיכה פוליטיים ■ יועמ"שית משרד השיכון טענה בפני ועדת האיתור כי "קיים ספק של ממש אם מתקיימים בעניינו של אליהו התנאים הקבועים בפסיקה לכישורים מיוחדים"
ראש הממשלה בנימין נתניהו, שר השיכון חיים כץ ושר האוצר בצלאל סמוטריץ' חתמו היום (ב') על מינויו של יהודה אליהו למנהלה החדש של רשות מקרקעי ישראל (רמ"י). אליהו מכהן כיום כראש מנהלת ההתיישבות במשרד הביטחון, ובעבר היה מנכ"ל עמותת רגבים. הוא נחשב מקורב לשר האוצר בצלאל סמוטריץ', קשר שעליו דיווח במינויו לתפקיד.
בשבוע שעבר ועדת האיתור למנהל רמ"י המליצה על אליהו לתפקיד, אף שקבעה כי קיימת זיקה בינו לבין סמוטריץ'. ארבעה מבין חמשת חברי הוועדה תמכו בהמלצה. היחידה שהתנגדה לה הייתה מנכ"לית שירות התעסוקה ענבל משש, בשל היעדר מינוי נשים לתפקידים בכירים במשרדי הממשלה.
להודעה שפרסמה הממשלה היא צירפה שורה של "המלצות" של ראשי רשויות ביו"ש וברחבי הארץ שתומכים במינויו של אליהו, צעד תמוה במיוחד במינוי של מי שאמור לנהל מולם את הקרקע של המדינה.
מכתבי התמיכה נדרשו ככל הנראה לאור המאבק שהתפתח בתוך ועדת האיתור, כשיועמ"שית משרד השיכון, עו"ד אפרת פרוקצ'ה, הציגה במהלך הדיונים התנגדות למינוי בשל הזיקה הפוליטית המשמעותית אל סמוטריץ'. בשל אותה זיקה התעכב מינויו של אליהו והוועדה התכנסה חמש פעמים. בפעם האחרונה היא המליצה על אליהו בלבד, כשהיא מציינת בפרוטוקול שאם הייתה ממליצה על שלושה מועמדים היו נבחרים לצד אליהו גם שולי אבני שוהם, ראש רשות התאגידים, וקובי ילוביץ', מנכ"ל חברת יסודות.
הדיון האחרון בוועדה נועד למעשה להכשיר את המינוי למרות התנגדותה של פרוקצ'ה. אליהו שלח לוועדה "כישורים מיוחדים" שאמורים היו לגבור על הבעייתיות שבזיקה הפוליטית, אלא שהיועמ"שית לא השתכנעה: "נוכח ציוני המועמדים האחרים, ניסיונם הרחב בנושאי מקרקעין ותכנון ובנייה, ניסיונם בשוק הפרטי והעסקי בנוסף על הניסיון הציבורי והמוניציפלי, התמחותם בנושאי ליבה של רשות מקרקעי ישראל, השכלתם, וההתרשמות הטובה של חברי הוועדה מהם עד כי ביקשו למעשה להמליץ גם עליהם בפני השרים, הביעה היועצת המשפטית את עמדתה לפיה מתעורר ספק של ממש אם מתקיימים בעניינו של מר אליהו התנאים הקבועים בפסיקה לכישורים מיוחדים".
בעיה נוספת שעליה הצביעה היועמ"שית היא העובדה ששוב הממשלה ממנה לתפקיד מפתח גבר. "נוכח העובדה שאחת משלושת המועמדים שעליהם ביקשה הוועדה להמליץ היא אישה, הזכאית מכוח כללי הייצוג ההולם להעדפה מתקנת, הנטל המוטל על הוועדה בהקשר זה הוא גבוה יותר. על הוועדה לבחון מדוע יש להעדיף את מר אליהו על פני מועמדת, אשר זכאית להעדפה מתקנת, וזאת על אף שהוועדה מצאה אותה ראויה להיבחר לתפקיד והיא נטולה זיקה לשר הממנה. נימוקי הוועדה בהקשר זה מעלים קשיים משפטיים של ממש".
לסיכום נכתב כי להערכת היועצת המשפטית "עשוי להתעורר קושי להגן על עמדת הוועדה להמליץ בפני השרים על מר אליהו, אם תוגש עתירה בעניין". ואכן צפויות מספר עתירות כנגד המינוי שיגיע בקרוב לדיון בבג"ץ, ואף עשוי להיות מוקפא בצו.
בוועדת האיתור היו חברים מהרן פרוזנפר, ראש אגף התקציבים באוצר; פרופ' עידית סולברג, נציגת ציבור; גיל רייך, מ"מ ראש המל"ל; מיכאל יצחקוב, מנכ"ל משרד התיירות; וכאמור ענבל משש, מנכ"לית שירות התעסוקה. בהחלטת הוועדה נכתב: "לאחר שנשקלו כל השיקולים הרלוונטיים, חברי הוועדה התרשמו כי המועמד יהודה אליהו הוא כשיר ומתאים ביותר לתפקיד, וזאת בהתאם לדירוג המשוקלל הניתן לו. אשר על כן, הבחירה במר אליהו היא בחירה סבירה והוא נמצא כמועמד הכשיר ביותר מבין המועמדים שהופיעו בפני הוועדה".
